This is It

My last exam in my first year as an undergraduate is in about 9 hours' time - Contract Law: A friend that I find very difficult to get to know and understand. "Commit your work to the Lord, and then your plans will succeed" -Proverbs 16:3- I'm claiming that with my whole heart and all the faith that I have within me!

Last Weekend in FB, ever.

Image
My last weekend in FB is ending in less than 10 minutes' time - what a sad thought. I had my very last brunch yesterday and took these two photos as a keepsake. The quality and colour of the photographs are really bad because I took them with my not-so-good handphone, what with my forgetting to bring down my camera to take proper shots. Just now, for the very last time, I also had roast chicken for dinner - thank God! Sunday dinners are definitely something I'm not going to miss about FB! Every Sunday night, there will DEFINITELY be roast chicken, with the other choice of something roasted as well, which may be lamb, pork or beef. EVERY SUNDAY IT'S THE SAME THING. No, what I'm really going to miss about the food here in FB is Saturday brunch.

1 more, 1 more

So. My past 2 papers haven't been complete, absolute disasters so I am not feeling all depressed and down-in-the-dumps. My last 3 hour paper, Contract Law, will be on the 27th of May, Tuesday, 9am (UK time. Plus 7 hours for S'pore time). Then it will be time to say goodbye to FB and my hall mates to leave Nottingham for Singapore on the 30th of May, Friday. Time to say goodbye... I'm not looking forward to it. Anyhow, Jolene let me listen to a song by a local artiste 伍家辉 (Wu Jia Hui), and I think he has a really nice voice! The first song I actually heard him sing was 一人一半 (yi ren yi ban). I later found out that he actually wrote a song that was performed by Jerry Yan and he performed it at Esplanade. I watched the clip and I think he did a much better version than Jerry Yan and I would like you to hear the difference with the hope of you agreeing with me. Ok, so here's the one by 伍家辉: Now listen to Jerry Yan's: (YAY FOR LOCAL MUSIC/ARTISTES!)

Seemingly Silly things from case-law for Life Application

1) Contract: Common mistake If you are about to marry someone who has been married before but now is a widow/widower, be sure to check and double-check that that person's spouse is actually dead. In Galloway v. Galloway (1914), the defendant assumed his wife to be dead and married the claimant, who later separated and entered into a deed of separation under which the defendant promised to pay a weekly allowance to the claimant. Then, lo and behold, the defendant discovered that his first wife was still alive and fell into arrears. When the claimant sued to recover the arrears it was held that she couldn't do so because the separation agreement was void on the ground that it was entered into under the common mistake that the parties were, in fact, married. 2) Tort: Defamation If you are going to publish a story in anything that is going to be widely read or circulated, be sure to give your characters the most ridiculous names that are simply out of this world so that there will...

Study Music

To shut out noise from neighbours or people playing football in the field just outside, I've been listening to classical music, or basically music that is instrumental, with no lyrics to it, as I would find myself paying attention to the words of the song playing instead of the words in the book in front of me. This is my favourite at present: It's by Sergei Vasilievich Rachmaninoff and there are three movements to this piano concerto. I first heard this song in the movie "Centrestage", then I heard it recently yet again on the Japanese drama serial "Nodame Cantabile". I hope you take time to download, listen and enjoy it!:)

May Disasters

For the past few days, the topics of the cyclone that hit Burma and the earthquake that hit China always come up during our meals together in the dining hall, especially with Allan being from China. Each morning, we ask each other what is the estimated death toll now in each disaster-hit zone, while Allan tells us that he is regularly checking the death toll in China climb. I just read this article from the website of BBC news and I thought it was quite a good comparison between the handling of the two disasters so I just want to share it with all of you - click here .

Laugh Out Loud - even though it may make you look like you've lost your mind

Image
It was a fabulous start to my day (and to the week) when I read the email Jolene sent me. I laughed and laughed and laughed when I read what she sent to me in the email. I'm just going to copy and paste what got me all nostalgic and happy first thing in the morning after breakfast: Guess what, i was clearing out all my notes today and i found two yellowed sheets of paper and discovered them to be ancient scripted records of TRF days! i shall type it out for you, spelling errors included: TRF (LAST EPISODE) MISTAKES AND SUGGESTIONS *Not in order MISTAKES 1) When in 2nd dimension (Janet): Janet is supposed to be in a daze, and cannot be too "awake". When monster is "hynoptising" Janet, words must be dragged but clear. After monster talks about marriage, he must get angry when Janet does not know what marriage and "cast a spell" on her. (hynotise) 2) Fighting (all scences) No power (kicks, punches) (Girls) Take a lot of effort to move but kicks and punche...

Pieces of the week Past

Image
Exactly one week ago, I met Janice and Hong Zhen for dinner at Nosh, which is in Beeston. The usually busy restaurant was eerily empty, as we were the only customers. Our voices seemed to bounce off all four walls of the restaurant, seeming way too loud and self-conscious. But it was a great dinner and a fantastic time of catching-up and talking about many "nothings". On Monday night, Jennifer and I watched the play titled "School for Scandal" at the Lace Market Theatre, together with our small group from the Christian Centre. One of the cell members had a role in the play and we were attending the very first performance of the week in support of him. It was rather weird actually because he has never met Jennifer and me before, we have never met him before the play. So it was strange going to support someone you don't know. But it was an interesting, engaging play and we enjoyed ourselves. Lastly, SUMMER IS HERE! (Apparently it is exceptionally warm for this tim...

Check out the Indian version

I was listening to songs on iTunes to shut out the noise coming from my neighbours' rooms when I heard the Chinese version of the song "Bet on It" from High School Musical 2. I was curious to see what the music video was like so I found it on YouTube. I clicked on a few interesting looking links and I found this video, that has songs from High School Musical in different languages. I was surprised at how the Indians adapted the song so that it would become their kind of style. I just HAVE to show it to you: (If you just want to watch the Indian version of the song "All for One", start from the time of 1:41) For comparison purposes, I've also included the original music video of the song "All for One" so you can see the difference between the original and the Indian versions:

Denning LJ: drama king

I'm now studying the tort of negligence: Breach of Duty. And every time they state something Lord Denning says in the cases, I just wonder why he has to be so... dramatic. Let me just give you one example. Usually, the claimant bears the burden of proving breach of duty of care, but there are certain circumstances in which special rules will assist in discharging this burden, such as the maxim res ipsa loquitur (which means "the thing speaks for itself"). Where the maxim applies, the court is prepared to draw an inference that the defendant has been negligent without requiring the claimant to bring evidence about the precise way in which the negligence occurred. In the context of failed treatment, as Denning L.J. put it in Cassidy v. Ministry of Health (1951), the plaintiff was entitled to say: "I went into hospital to be cured of two stiff fingers. I have come out with four stiff fingers and my hand is useless. That should not happen if due care had been used. Exp...

Why are you downcast, O my soul?

Why are you downcast, O my soul? Why so disturbed within me? Put your hope in God, for I will yet praise him, my Saviour and my God. -Psalm 42:11- I attended cell group tonight and I was reminded of how sovereign God is and how I have been made to praise Him so that my attention will be turned upon Him, away from my circumstances and the things clouding my vision of Him. Yesterday was a terrible day for me. The feeling of loneliness, discouragement and despair was truly immense, too heavy to bear. I may be going back to Singapore soon, but it is not tomorrow. So please don't tell me that. I already know it but it is not helping me to feel or cope better. Yet I will put my hope in God. I will wake each morning with praise for You. I will remember that You are constant. I may not feel You around all the time but I'm never alone, no matter how lonely I feel. I put my hope in You.

Calm. Normal heart rate.

Goal for the remainder of the month of May: To be calm and to keep up a normal heart rate whenever I think of the impending doom called Exams. Summer is here. I can walk out in a t-shirt and jeans without any cardigan or jacket. I could even wear my Birks out, store away my boots. People are wearing t-shirts and shorts/bermudas/mini denim skirts. They are out on the fields reading, playing soccer, playing tennis. Enjoying the sun. I am in my room struggling to keep up a calm and determined spirit, trying to ignore the inner complaint of "The weather is so wonderful and you're cooped up in your room. What kind of life is that". Well, I asked for it, isn't it? I could have chosen to do a course that is not as demanding and heavy as Law. But I chose to become a Law student anyway. So, I asked for it (According to a hallmate who said this to me at breakfast a few days ago, first thing in the morning. Fantastic way to start the day). I feel the stress and the panic threate...

By the way: HAPPY BIRTHDAY!

Image
Dear Gege, Thank you for being such a wonderful brother to me this past 20 years. I read novels, watch drama serials and movies, and hear of stories from people around me, of how when as children, the older brother would be a big bully or be mean to the younger sibling. Reflecting on my childhood days, I don't recall any bullying or mean things from you, and I want to thank you for that. Sometimes I wish we could go back to the days in Pasir Panjang where we shared the same room, with you sleeping on the pull-out bed, with me waking up on certain days to find one of your legs resting on my bed and having to push your leg down so I'll have "my own space", at the same time hoping I will not wake you up when I actually do push away your leg... :) But I digress. HAPPY BIRTHDAY GEGE!

Random Thoughts

1 silly/scary thing: Legal concepts and cases are invading my everyday life and thinking. You see, Allan popped by my room not long after getting back from his daytrip to Cardiff with the intention of getting snacks from me just now, but I had none for him. Yesterday, he had passed me his meal card for me to go to the library to buy some snacks using up the credit on his card. However, this morning, I decided not to go to the library to study after all. So I passed his card to Michelle, who was still going to the library. In the afternoon, she came back to tell me that Allan's card had been confiscated because they noticed that Michelle wasn't using a card that had a photo of a GIRL! Thus, when Allan popped by just now, I apologised profusely and told him we'd go down to the library together tomorrow to attempt to retrieve his meal card. If it does not work out, we will have to wait until Monday to head down to the catering office. He did not get very angry or anything like...

Learn with me: Exclusion Clauses (Contract)

- Exclusion clause = clause in a contract or term in a notice which appears to exclude or restrict a liability or legal duty which would otherwise arise. - 3 hurdles to overcome if a contracting party wishes to include an exclusion clause: (1) Properly incorporated into the contract. (2) Construction of exclusion clauses such that, when properly interpreted, covers the loss arisen - contra proferentum rule, where any ambiguity in the exclusion clause is resolved against the party seeking to rely on it. (3) There must be no other rule of law which would invalidate the exclusion clause. - Negligence liability, 3 specific rules of construction in Canada Steamship Lines Ltd v. The King (1952), Lord Morton of Henryton. More clement approach taken by the House of Lords in HIH Casulty and General Insurance Ltd. v. Chase Manhattan Bank (2003). - Fundamental breach, 2 approaches: (1) Rule of law approach - laid to rest by House of Lords in Photo Production Ltd v. Securicor Transport Ltd (198...

Last FB Formal dinner

Image
My fourth, and final, formal dinner in Florence Boot hall was a good one. In the previous formal dinners, I always thought the food was being served at snail-pace and it just seemed like a waste of good night-time hours. Tonight, the food was good. The company was good. The 3 short speeches we received from the warden, guest (part of the FB alumni) and hall president respectively were good. I think the best thing of today was that we took a hall photo and, because the weather was absolutely wonderful, we could take an outdoor shot. I do not have the group photo with me at this present moment, but when I do get it, I am definitely going to scan it in and post it for all of you to see. One thing that's really got me thinking though, is how Westerners can seem to be so full of themselves, as seen from the way they look at us foreigners like we are Aliens and, as aliens, we think on a completely different and hence abnormal frequency from them. I have heard of stories where it shows th...
